Who can file a consumer complaint ?

A consumer as per the definition provided in the Consumer Protection Act, 1986 can file a consumer complaint. Such a complaint can also be filed by the following persons/entities:

  •  Any voluntary consumer protection association
  •  A group of consumers having same or similar interest in the concerned goods and services 
  •  Central/State Government 
  •  In the event of a consumer’s death, his/her legal heir/representative

Who is a consumer ?

As per the provisions of Sec 2(1)(d) of the Consumer Protection Act, 1986, a consumer is anyone who would purchase goods/services in exchange for consideration which could be paid or promised in part or in full. The definition also includes a person who would consume goods with the buyer’s consent and not for resale/manufacturing purpose.

Should a consumer directly file a complaint with the consumer forum ?

No. Prior to filing a complaint with the Consumer Forum, a consumer should first send a notice to the other party concerning the defect in the concerned product or service. if the other party is in denial mode and/or refuse to pay damages/replace the product then the consumer should look for the appropriated jurisdiction and file consumer complaint with the Consumer Forum.

What is the jurisdiction for Consumer Forum ?

A consumer can file his complaint to a Consumer Forum which has territorial as well as pecuniary jurisdiction in order to take a call on the concerned matter.  

What is territorial jurisdiction ?

Territorial jurisdiction means the local limits of the jurisdiction within which:

  • Opposite party resides or does business or works for personal gain OR 
  • If there is more than one opposite party, one of the opposite parties does the above 
  • Cause of action has arisen

Territorial jurisdiction complaint may be filed with District Forum or the State Commission or the national Commission but within the above stated local limits.

What is pecuniary jurisdiction ?

Pecuniary jurisdiction means the consumer complaint is fled with such designated forum with designated amount limits with respect to the value of goods and services involved.
